To avoid making the text more cumbersome, the use of the name Prismont also refers to its parent company Montfort International Ltd.

Prismont may at any time modify its Terms & Conditions. When we make changes to these Terms and Conditions, we will revise the “Last Updated” date at the bottom of this webpage. The modified Terms and Conditions will be in effect as soon as they are posted on the Site. Moreover, your continued use of the Site after notification of modifications to the present agreement constitutes your agreement to the modified stipulations.

You agree that you are solely responsible for all message and data charges that apply to use of your mobile device to access the Prismont site. All such charges are billed by and payable to your mobile service provider.
You understand that wireless through Wi-Fi or a participating mobile service provider may not be available in all areas at all times and may be affected by product, software, coverage or other service changes made by your mobile service provider or otherwise.
You will be required to create an account in order to make a purchase on the Website. Receipt of your order will be confirmed via an automatic e-mail to the e-mail address associated with your account. Such e-mail is a confirmation that your order has been received by Prismont but does not constitute an acceptance of your order. A shipping confirmation e-mail will be sent to confirm that your order has been accepted and that the order has been shipped.
You will not be able to make changes to your order once you have submitted it. Prismont reserves the right, at its sole discretion, to cancel or refuse any order for any reason. Some situations that may result in your order being cancelled or refused are (i) limitations on quantities available for purchase; (ii) inaccuracies or errors in product or pricing information on the Website; or (iii) our inability to confirm or obtain authorization for charges to your credit card. Prismont periodically schedules system downtime for the Prismont Site for maintenance and other purposes. Unplanned system outages also may occur. You agree that Prismont has no responsibility and is not liable for:
The unavailability of the Prismont Site;
any loss of data, information or materials caused by such system outages;
the resultant delay, mis-delivery or non-delivery of data, information or materials caused by such system outages;
Any outages caused by any third parties, including without limitation any companies or servers hosting the Prismont Site, any Internet service providers or otherwise.

Prismont also may in its sole discretion and at any time discontinue providing the Prismont Site, or any part thereof, with or without notice. The sale of the products described herein is subject to and governed solely by these Terms & Conditions and no terms or conditions or Purchaser’s purchase order, any agreement or any other understanding shall be binding on Prismont or apply in any manner to the sale of such products. No modification of these Terms & Conditions shall be of any force or effect unless signed by an authorized officer of Prismont. No specification, drawing, print or photograph prepared by Purchaser relative to Purchaser’s order shall be binding on Prismont for any purpose unless signed by an authorized officer of Prismont.

Prismont will not be liable for and is not responsible for any indirect, special or consequential damages arising out of this agreement under any circumstances, including, but not limited to, loss of life, personal injury, loss of income (business or personal), damage or loss (including any increased costs suffered or incurred by customer) resulting from customer’s inability to use the goods or customer’s (or its customer’s) inability to use any equipment, or any increased operating costs or loss of production or other costs incurred by customer (or any customer of customer) in removing, reinstating or repairing allegedly defective or nonconforming goods, delay damages or any other such damages, whether arising from causes similar to or dissimilar to those enumerated.
Prismont disclaims any liability for failure of performance or malfunction of the goods supplied by Prismont pursuant to the agreement which in Prismont’s opinion is the direct or indirect result of any action or inaction by customer or any party other than Prismont. This includes, without limitation, abuse, neglect, accident, improper installation, modifications or repairs not made by Prismont, incorrect or inappropriate use or application, failure to maintain, unsuitability or incompatibility with other products or equipment not supplied by Prismont, or the presence of non-recommended fluids or other contaminants.
Notwithstanding any provision hereof which may be or appear to be to the contrary, in no event whatsoever shall Prismont’s liability in respect to any claim or action of any kind arising out of, in connection with, or resulting from the manufacture, sale, delivery, resale, use or repair of the goods or component parts thereof or the services rendered by rockford systems pursuant to the agreement, or any breach by Prismont of any term of the agreement, exceed the price for the goods or component part thereof or service which gives rise to such claim or action.
Customer assumes all other liability for any loss, damage or injury to persons or property arising out of, connected with or resulting from the use of the goods, either alone or in combination with other products, including, without limitation, any “special damages” or any loss, damage or injury to customer (or to customer’s employees or property or to the employees or property of any customer of customer or other user of the goods) due to the acts or omissions of customer, its agents, employees or customers, in the installation, maintenance, use or operation of such goods.
Notwithstanding anything to the contrary set forth in this agreement, including any indemnification obligation, Prismont shall have no obligation to customer for any liability arising from:
Any personnel (including any 3rd party contractor) of customer placing any body part in machinery, operating machinery without proper eye, face or body protection or appropriate training, operating machinery that has not been maintained in a manner consistent with industry standards or operating machinery that has been tampered, rewired or bypassed by customer or any third party
A mechanical defect, malfunction or failure in machinery or component thereof or otherwise resulting from customer’s breach of the agreement
The parties acknowledge that the allocation of risks and benefits under this agreement is based on, and the fees paid under this agreement would be greater in the absence of, the limitations described above. This section will survive termination of this agreement.

Delivery times may vary depending on the location of the customer, the date of the order and the products ordered. Each of the Prismont products which can be purchased directly online has an estimated delivery delay displayed on the page depending on the sub-model or size of the product.
If the product purchased is a stock item, Prismont ships within 1-5 business days. If it is not in stock, it is on special order, and the customer will have to expect a longer delivery time of about 4 to 6 weeks.
During holidays and company closing times, no order will be processed, which may lead to longer delivery times.
Orders are shipped using UPS. The rate charged for the shipping of your order is based on your location and the size and weight of your products. Before the final checkout page you will be shown the cost of shipping. Individual UPS accounts may be used for all shipments during checkout. Prices specified are for standard packaging only. Any special packaging requested by the Customer, including special protection for export shipment, will be at the Customer’s expense. Prismont uses a third party shipping service provider to ship its products. As such, Prismont will not be liable for any loss, damages (direct or indirect) or expense due to shipping.
Broker, duty, local taxes and custom fees are the responsibility of the receiver and are not included in the shipping cost. If you need any detailed information about these charges, please contact your local customs office. Unloading is at the risk of the buyer.
Customer shall be responsible for obtaining any necessary governmental clearances, including any import and/or foreign exchange license, which may be required by the federal, any state or any foreign government, or any subdivision or agency of any thereof.

When delivering the goods to the shipping destination designated by the customer, the customer must promptly inspect the contents of the package delivered to ensure that it is consistent with the order and in good condition.
Any claim for errors in the order must be made in writing and received by Prismont within 10 days of receipt of the goods by the Customer, accompanied by documentation in support of the claim.
All refunds will be processed using the same method of payment as the original purchase.
Any returns for a product that has been installed, damaged, modified, or returned incomplete will be refused.
The minimum re-stocking charge will be 20% (minimum 25$CAD, 25 euro, 25$USD depending of the transaction currency used) for any material not found to be defective. Such merchandise must be in original condition and unused to qualify for credit.
Custom, special or built to order items may not qualify for credit. No returns for credit will be considered more than 30 days from date of shipment.
The restocking fee does not apply to exchanges or warranty claims. The shipping costs are not refundable. Custom orders require advance payment and can not be returned.

Returned merchandise must be authorized by Prismont in advance, at which time a Return Materials Authorization (RMA) number will be issued. No returned merchandise will be accepted unless accompanied by an RMA number, with the RMA number clearly identified on the outside of the shipping container.
